How can Banks legally charge services charges on bank machine in 2008 – I don’t think it is new tech anymore?

Question by Gilles T: How can Banks legally charge services charges on bank machine in 2008 – I don’t think it is new tech anymore?
I am an IT professional and there is no way that anyone is going to convince me that automated tellers cost the banks more money then having staffed tellers serving the public. Or that these banks will convince me that they have no control over their automated computer systems charging. So how could every bank around still charge for using bank machines and this and that. For anyone who thinks there are Gasoline price conspiracies I would rather look at the financial industry and their practices of adding fees. Credit Card issuers (still the same banks) now have a whole gamut of new Credit Card surcharges. These won’t stop until people get angry enough or bring them to court.

My question is – have there been any lawyer that have looked at this seriously, or is everyone just rightfully scarred of the large Banks?
